By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

HealthAnxiety.ai provides an AI-powered companion designed to help people manage health anxiety through CBT-based conversation, pattern tracking, and emotional support. The Service is intended for general wellness and emotional support purposes only.

HealthAnxiety.ai is NOT a medical device. It is not regulated by the FDA or any equivalent authority. It does not diagnose, treat, cure, or prevent any medical condition or mental health disorder.

The Service uses artificial intelligence to generate responses. AI-generated content may be inaccurate, incomplete, outdated, or inappropriate. You should independently verify any information provided by the Service before acting on it.

2. Not a Substitute for Professional Advice

The information and support provided by HealthAnxiety.ai is for informational and emotional support purposes only. It does not constitute medical, psychological, or psychiatric advice, diagnosis, or treatment.

Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition or mental health concern. Never disregard professional medical advice or delay seeking it because of something you have read or heard through HealthAnxiety.ai.

If you are experiencing a medical or psychiatric emergency, contact emergency services (911 in the US, 999 in the UK, 000 in Australia) or go to your nearest emergency room immediately.

3. User Eligibility

You must be at least 18 years old to use HealthAnxiety.ai. By using the Service, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use the Service.

4. Acceptable Use

You agree not to use HealthAnxiety.ai to:

Violate any applicable laws or regulations
Impersonate any person or entity
Attempt to gain unauthorized access to our systems
Transmit harmful, abusive, or objectionable content
Use the Service for any commercial purpose without prior written consent
Attempt to reverse-engineer or extract model weights or proprietary algorithms

We reserve the right to terminate or suspend access to the Service for violations of these Terms, at our sole discretion and without prior notice.

5. AI-Generated Content

The Service relies on third-party large language models to generate responses. You acknowledge and agree that:

AI-generated responses may contain errors, inaccuracies, hallucinations, or outdated information.
The AI is not a licensed medical professional, therapist, counselor, or healthcare provider of any kind.
You assume all risk associated with your reliance on AI-generated content.
AI responses do not reflect the opinions or endorsements of S Squared Labs, LLC.
The Company does not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content for any purpose.

6. Intellectual Property

You retain ownership of the content you submit to the Service (“User Content”). By submitting User Content, you grant S Squared Labs, LLC a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of operating and improving the Service.

AI-generated responses are provided “as is” for your personal use. The Company makes no ownership claims over AI-generated output.

The HealthAnxiety.ai name, logo, and all related branding are trademarks of S Squared Labs, LLC. You may not use them without our prior written consent.

7. Subscription & Billing

HealthAnxiety.ai offers both free and paid subscription plans. Paid subscriptions are billed as auto-renewable subscriptions through Apple App Store or Google Play Store. By subscribing, you agree to the pricing, subscription length, and billing terms displayed at the time of purchase.

Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. You may cancel at any time through your device's subscription management settings. No refunds are provided for partial subscription periods except as required by applicable law or the policies of the applicable app store.

Pricing may change from time to time. We will notify you of price changes in advance in accordance with app store requirements.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, S SQUARED LABS, LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

WITHOUT LIMITING THE FOREGOING, THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: (A) YOUR RELIANCE ON AI-GENERATED CONTENT; (B) ANY DECISIONS YOU MAKE BASED ON INFORMATION PROVIDED BY THE SERVICE; (C) ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SERVICE; OR (D) ANY UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.

IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

The Service is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Indemnification

You agree to indemnify, defend, and hold harmless S Squared Labs, LLC and its officers, directors, members, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your reliance on AI-generated content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11. Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Delaware, United States, and the arbitrator's decision shall be final and binding.

YOU AND THE COMPANY EACH WAIVE THE RIGHT TO A TRIAL BY JURY. YOU ALSO WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR OTHER REPRESENTATIVE PROCEEDING.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date above and, where appropriate, by notifying you through the app. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
